Welcome to djnajade.com (“Website”), operated by NaJade (“NaJade,” “we,” “us,” or “our”). By accessing this Website, booking our services, or enrolling in lessons, you (“you,” “the Client,” “the Student”) agree to these Terms & Conditions. Please read them carefully.
1. Services
NaJade provides DJ performance services for events, clubs, bars, restaurants, weddings, corporate functions, and private parties, as well as DJ lessons delivered in person and online. The specific scope, duration, and deliverables of any service are defined in the individual booking confirmation or agreement.
We reserve the right to refuse service to anyone, for any lawful reason, at our sole discretion.
2. Bookings & Confirmation
2.1. A booking is only confirmed once (a) we issue written confirmation and (b) the required deposit is received.
2.2. An enquiry, quote, or verbal agreement does not constitute a confirmed booking and does not reserve any date.
2.3. Dates are held on a first-paid basis. We are not liable for a date becoming unavailable before a deposit is received.
2.4. The Client is responsible for ensuring all booking details (date, time, location, event type, duration) are accurate. NaJade is not liable for issues arising from incorrect information supplied by the Client.
3. Payment
3.1. A non-refundable deposit of 50% of the total fee is required to confirm any booking.
3.2. The remaining balance is due no later than 7 days before the event date, unless otherwise agreed in writing.
3.3. For bookings made within 7 days of the event, full payment is required upfront.
3.4. Lessons must be paid for in advance of each session or package.
3.5. All prices are quoted in Thai Baht (THB) unless stated otherwise. The Client is responsible for any bank transfer fees, currency conversion costs, or transaction charges.
3.6. Late payment of the balance may result in cancellation of the booking with the deposit forfeited.
3.7. Travel, accommodation, equipment hire, and any additional costs for events outside Bangkok are billed separately and added to the final invoice.
4. Cancellations & Refunds
4.1. By the Client:
- The deposit is non-refundable under all circumstances.
- Cancellation more than 30 days before the event: balance not yet due is waived; deposit forfeited.
- Cancellation 14–30 days before: 50% of total fee payable.
- Cancellation fewer than 14 days before: 100% of total fee payable.
4.2. Rescheduling is subject to availability and must be requested in writing at least 14 days in advance. We may accommodate one reschedule at our discretion; the deposit transfers to the new date. Repeated rescheduling may be treated as a cancellation.
4.3. By NaJade: In the unlikely event we must cancel due to illness, emergency, or circumstances beyond our control, we will either (a) arrange a suitable replacement DJ of comparable standard at no extra cost, or (b) refund all monies paid. Our total liability for cancellation is strictly limited to the amount paid by the Client. We are not liable for any consequential losses (e.g., venue costs, other vendors, travel).
4.4. Force Majeure: We are not liable for failure to perform due to events beyond our reasonable control, including but not limited to natural disasters, extreme weather, government action, public health emergencies, civil unrest, power failure, venue closure, or transport disruption. In such cases we will make reasonable efforts to reschedule.
5. Client & Venue Responsibilities
5.1. The Client must ensure the venue provides safe, adequate, and legal access to power, space, and shelter for equipment.
5.2. The Client is responsible for obtaining all necessary licenses, permits, and permissions required for music to be played at the event, including any public performance or venue licensing, unless explicitly agreed otherwise in writing.
5.3. The Client is responsible for the conduct of their guests. NaJade reserves the right to stop performing and leave, without refund, if there is any threat to the safety of NaJade, the equipment, or any person, including abuse, violence, harassment, or illegal activity.
5.4. The Client is liable for any damage to or loss of NaJade’s equipment caused by the Client, their guests, or the venue, and agrees to reimburse the full repair or replacement cost.
5.5. Any request to extend performance time on the day is subject to NaJade’s agreement and charged at an additional hourly rate, payable immediately.
6. Equipment & Performance
6.1. NaJade uses professional equipment and takes all reasonable care. We are not liable for delays or failure to perform caused by venue-supplied equipment, power issues, or conditions outside our control.
6.2. NaJade retains full creative control over music selection, mixing, and performance style, taking the Client’s reasonable preferences into account. Music selection is ultimately at NaJade’s professional discretion.
6.3. Specific song requests are accommodated where reasonably possible but are not guaranteed.
7. DJ Lessons
7.1. Lesson packages must be paid in advance and are non-refundable once the first session has taken place.
7.2. Sessions cancelled by the Student with fewer than 24 hours’ notice are forfeited and non-refundable.
7.3. Lesson packages are valid for 3 months from the date of purchase unless otherwise stated. Unused sessions after this period expire without refund.
7.4. NaJade provides instruction and guidance only. We make no guarantee of any particular outcome, skill level, employment, or income resulting from lessons.
7.5. For in-person lessons, the Student uses equipment at their own risk and is liable for any damage caused.
8. Intellectual Property
8.1. All content on this Website — including text, logos, the NaJade name and brand, graphics, photos, mixes, and design — is the property of NaJade and protected by copyright and trademark law. You may not copy, reproduce, distribute, or use any content without our prior written permission.
8.2. Any mixes, recordings, or content created by NaJade remain the intellectual property of NaJade. Clients may not commercially reproduce, sell, or redistribute them without written consent.
8.3. NaJade reserves the right to record, photograph, or film performances and lessons and to use this content for promotional purposes (social media, website, marketing) unless the Client requests otherwise in writing before the event.
9. Media & Promotion
9.1. By booking NaJade, you grant permission for NaJade to reference the event (type, general location, date) and use any photos or video captured for portfolio and marketing purposes, unless you opt out in writing in advance.
9.2. If you require strict privacy (e.g., a private celebrity event), this must be agreed in writing before the booking is confirmed.
10. Limitation of Liability
10.1. To the maximum extent permitted by law, NaJade’s total liability arising from any booking or service shall not exceed the total fee paid by the Client for that specific service.
10.2. NaJade is not liable for any indirect, incidental, or consequential losses, including loss of enjoyment, loss of profit, third-party vendor costs, or venue penalties.
10.3. Nothing in these Terms excludes liability for death or personal injury caused by proven negligence, or any liability that cannot be excluded by law.
11. Website Use
11.1. This Website is provided “as is.” We make no guarantee that it will be error-free, uninterrupted, or secure.
11.2. We are not responsible for the content of any third-party websites linked from this Website.
11.3. You agree not to misuse the Website, attempt unauthorized access, or use it for any unlawful purpose.
12. Privacy & Data
12.1. We collect and process personal data (such as name, contact details, and event information) only to provide our services, in accordance with our Privacy Policy and applicable Thai law, including the Personal Data Protection Act (PDPA).
12.2. We do not sell your personal data to third parties.
12.3. By contacting us or booking, you consent to us storing and using your information for the purpose of fulfilling your booking and related communication.
13. Third-Party Platforms
Links to external platforms (Instagram, TikTok, YouTube, SoundCloud, Twitch, Mixcloud, LINE, etc.) are provided for convenience. We are not responsible for the content, policies, or practices of these platforms.
14. Changes to These Terms
We may update these Terms & Conditions at any time. The current version will always be posted on this Website with the “Last updated” date. Continued use of the Website or our services after changes constitutes acceptance of the revised Terms.
15. Governing Law
These Terms & Conditions are governed by the laws of Thailand. Any dispute arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Thailand.
